Terms of Service, Privacy Policy, "No-Spam" Policy and more
Thanks you for using Evereq!
We want to keep to some 'principles' of how Evereq network of sites operates and what we expect from our users.
We believe we can express this in 'normal' language... OK, we at least will try this :D
If you aren't happy with this normal language, we try also to write it in formal language (scroll down).
Please note that both are still early versions, so expect to see many improvements & changes ones we move close to Alpha / Beta versions.
Our Principles
- We are open for any changes & feedback. If you feel something wrong, please let us know and we do our best to fix it
- Who can use Evereq sites? Everybody, unless you're under 13.
- All content you post to any site in the Evereq network is ONLY YOURS! You can show it on Evereq sites to other people or post it private so only you can see it or even copy it outside our network of sites or ask us to remove it (see exception below).
- At the same time, it's ONLY yours responsibility to make sure you do it according to USA and international Copyright and other Laws in the case when site from Evereq network registered and operate outside USA. Best way to do this is to make sure that content is created by you or licensed the way that you can post it anywhere
- The only exception when we can't guarantee to remove your content is when other people copy your content some way, for example using our ReEver feature. Even in this case you are free to ask ask to remove it, we will try our best
- Evereq can remove your content from any site in our network if see that it's not legal to host it, for example if its infringes the rights of somebody else.
- If you see that somebody infringes your copyrights or try to make any damages to you or your business, please let Evereq team know and we will remove such content and block such bad user ASAP.
- We try our best to protect your security or sensitive information as much as possible (for example in private Evers or in other places, we also encrypt your passwords and so on), however Evereq is still prototype and pre-alpha application and so errors may happen. The only thing can be 100% sure is that we do NOT sell or disclose your sensitive information! Unlike some other sites, we want that all information truly belong to you! (and security is something we will 100% improve significantly in the future)
- Almost all Content contains some Links outside Evereq sites. Sure we do NOT responsible for such links, where they will drive you and what you get as end result. Be careful when press any links anywhere in the open WEB.
- Evereq sites can stop services to anyone, ones we feel and CAN PROVE that he do / did something wrong, i.e. do or did something that is restricted by laws or try to harm some people, business or service someway.
- If somebody sue us because of what you are doing on any of Evereq site (most probably copyright issues, but also porn or something similar), you should pay it all. We are not responsible for how our users use our services!
- We can't guarantee that Evereq services and sites will work without any issues and forever. We can decide to close any of them in any moment. We also never promise that it will be perfect. Still read first principle, your feedback is VERY important for us

Terms Of Service
Any site from Evereq network ("Evereq") lets you create your collection of material from around the internet to save for viewing, reading or accessing later on Evereq.com or any other site from Evereq network (the "Sites") and through third party applications that we may choose to work with or who use our Services.
We call the services available on this Site and any site from Evereq network of sites, whether accessed directly, or through the Mobile Software or such third party applications, the “Service(s)”.
Evereq services are provided by Evereq, Inc, a Delaware Incorporated Company with Research & Development (R&D) center located in Israel ("Evereq Israel").
These Terms of Service ("Terms") apply to all visitors, registered users, and others who access the Service (“Users”). Please review the following Terms carefully and contact us if you have any questions. By accessing or using our Services and Products, you agree to be bound by these Terms, our Privacy Policy, Copyright and Trademark usage Terms. Subject to these Terms and our policies, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Products and Services. Except as expressly provided in these Terms, you agree not to use, modify, reproduce, distribute, sell, license, or otherwise use our Products and Services without our permission.
1. Sharing Your Content
Evereq sites allows you to post (store) content using our Services, including photos, comments, links, URLs, articles, material, snippets, videos and other materials. Anything that you post, display, or otherwise make available on our Service, including all Intellectual Property Rights (defined below) in such content, is referred to as “User Content.”. You retain all of your rights in all of the User Content you post to our Service. You are solely responsible for all of the User Content you post to our Service. Subject to any applicable account settings you select, you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, display, reproduce, modify (e.g., re-format), re-arrange, create derivative works, re-post and distribute your User Content on any site from Evereq network or through our APIs for the purposes of operating and providing the Service(s) to you and to our other Users. Nothing in these Terms shall restrict our rights under separate licenses to User Content. Please remember that the our Service is a public platform, and that other Users may search for, see, use, and/or re-post any User Content and/or make available in other means any content that you make publicly available through the Service.
You are responsible for your content and you have the necessary licenses, rights, consents, and permissions to use and authorize us to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Your Content to enable inclusion and use of the Your Content in the manner contemplated by our Services and these Terms.
You agree that we are free to use Comments, Ideas or Feedback you submit to us about our Products and Services without any restriction or compensation to you. By accepting your submission, Evereq does not waive any rights to use similar or related Feedback previously known to Evereq, or developed by Evereq, Inc or Evereq employees or contractors, or obtained from sources other than you.
Following termination or deactivation of your account, or if you remove any User Content, we may retain your User Content for a commercially reasonable period of time for backup, archival, or audit purposes.
Furthermore, we and other Users may retain and continue to display, reproduce, modify, re-arrange, create derivative works, re-post and distribute any of your User Content that other Users have added to their areas of our services or which you have posted to public or semi-public areas of the Service or via our APIs.
2. Your Account
You are not required to register for an account with Us in order to use our Sites or Services. However, in order to use some specific features and sections of Our Services, You must create and register an account. We require that if You register, You must enter some personal information about Yourself so that We are able to comply with State, Federal and International Laws regarding our Services. When you create your account, you must provide us with accurate and complete information. Any use or access by anyone under the age of 13 is prohibited. You are entirely responsible for all activity which occurs through the use of Our Services and You are entirely responsible for a biding to all applicable jurisdictional local, state, national and international laws, treaties and regulations in relation to Your use of Our Site and/or Services, including those specific laws and/or treaties which concern data privacy, international data sharing and/or communication and any related transmissions of data which concern and/or detail technical or personal information. In order to use our Services to derive income, You are accepting that you are of legal age to use our services. You are responsible for your account and keeping it up to date and with access to relevant information in the event that we must contact you. You are solely responsible for any acts you undertake with other users and/or any all such consequences which arise from such acts and we have the right, but not the obligation, to take no action in the resolution of such acts.
You can terminate your account at anytime and we may permanently terminate your account or suspend without notice in our sole determinate if you violate any provision of any agreement detailed on this website. You will still be bound by the relevant provisions of our Copyright Policy on termination.
3. Evereq Content
Except for User Content, the Service itself, all content and other subject matter included on or within the Service, and all Intellectual Property Rights in or related to the Service or any such content or other subject matter (“Evereq Content”) are the property of Evereq and its licensors. Except as expressly provided in these Terms, you agree not to use, modify, reproduce, distribute, sell, license, or otherwise exploit the Evereq Content without our permission. We grant you a license to use the Service, including accessing and viewing Evereq Content, for your personal, noncommercial use to allow you to express yourself, discuss public issues, report on issues of public concern, engage in parody and as expressly permitted by the features of the Service. Evereq may terminate this license at any time for any reason or no reason. Except for the rights and licenses expressly granted, Evereq reserves all other rights and no other rights are granted by implication or otherwise.
4. Copyright Policy
In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Evereq will respond reasonably to claims of copyright infringement committed using our Services or websites (the "Sites") that are reported to our Designated Copyright Agent.
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site(s) by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent:

Upon receipt of the Notice as described below, we will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site.
You must:
- Identified the copyright work claimed infringed
- Must be able to reasonably locate the material and at a minimum include the url said to be infringing
- Provide your mailing address, telephone number and email.
- Include the statement a. "I hereby state that I have a good faith belief that the disputed use of the copyrighted material or reference or link to such material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."

5. Trademarks
Evereq respects the trademark rights. Any trademarks, logos and service marks displayed on this website are the property of their owners, whether Evereq or Evereq, Inc or third parties. Any content that misleads others or violates another’s trademark may be updated, transferred or permanently suspended on Evereq sites and services. This includes, but not limited to, usage of trademarks in usernames, posts titles, board names and so on. If you are worried that someone may use your or somebody else trademarks in an infringing way, please let us know by email to legal@evereq.com. We will review your information and take whatever action, in its sole discretion, it deems appropriate, including temporary or permanent removal of the trademark from our site. Evereq, Inc may owns a number of trademarks related to Evereq and use of these is subject to compliance with Evereq trade mark policy.
6. Security
We care about the security of our users and our services. While we work to protect the security of your content, private information and account details, we cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account or private information.
7. Third-party Links, Sites and Services
The Service may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Evereq, Evereq, Inc, Evereq Israel or any related entities. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from the Service, you do so at your own risk and you agree that we will have no liability arising from your use of or access to any third-party website, service, or content.
8. Indemnity
You agree to indemnify and hold harmless Evereq, Inc and Evereq Israel and its officers, directors, employees and agents, from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs and expenses, including, without limitation, reasonable legal and accounting fees (including costs of defense of claims, suits or proceedings brought by third parties), arising out of or in any way related to (i) your access to or use of the Services or Evereq Content, (ii) your User Content, or (iii) your breach of any of these Terms.
9. Disclaimers
THE SERVICES, INCLUDING WITHOUT LIMITATION ALL CONTENT AND OTHER SUBJECT MATTER INCLUDED WITHIN THE SERVICES, ARE PROVIDED ON AN "AS IS" AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, EVEREQ SPECIFICALLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. We take no responsibility and assumes no liability for any User Content that you or any other User or third party posts or sends over the Service. You are solely responsible for your User Content and the consequences of posting or publishing it, and you agree that we are only acting as a passive conduit for your AND OTHER USERS’ online distribution and publication of your AND THEIR User Content. The Service is controlled and operated from its facilities in the United States and Israel. Evereq makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are entirely responsible for compliance with all applicable national, state, local or other laws, statutes, directives, rules, regulations, and all interpretations or orders of any government, administrative or regulatory authority or court, including but not limited to those related to export and import of software, technical information or services. You may not use the Service if you are a resident of a country embargoed by the United States or Israel, or are a foreign person or entity blocked or denied by the United States or Israel governments. Unless otherwise explicitly stated, all materials found on the Service are solely directed to individuals, companies, or other entities located in the United States and Israel.
11. Arbitration and Governing Law
For any dispute you have with Evereq, you agree to first contact us and attempt to resolve the dispute with us informally. In the unlikely event that Evereq, Inc has not been able to resolve a dispute it has with you after attempting to do so informally, we each agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) arising out of or in connection with or relating to these Terms, or the breach or alleged breach thereof (collectively, “Claims”), by binding arbitration by the American Arbitration Association (“AAA”) under the Commercial Arbitration Rules and Supplementary Procedures for Consumer Related Disputes then in effect for the AAA, except as provided herein. Unless you and Evereq agree otherwise, the arbitration will be conducted in the county where you reside. Each party will be responsible for paying any AAA filing, administrative and arbitrator fees in accordance with AAA rules. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING, AND, UNLESS WE AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS. YOU AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND EVEREQ ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. The Service shall be deemed solely based in California and the Service shall be deemed a passive one that does not give rise to personal jurisdiction over Evereq, either specific or general, in jurisdictions other than California. These Terms shall be governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. We each agree to submit to the personal jurisdiction of a state court located in Santa Clara County, California or the United States District Court for the Northern District of California, for any actions for which either party retains the right to seek injunctive or other equitable relief, as further described in the Arbitration provision above.
12. General
When we change the Terms in a material manner, we will update the ‘last modified’ date at the bottom of this page. Evereq may, in its sole discretion, modify or update these Terms from time to time, and so you should review this page periodically. Your continued use of the Service after any such change constitutes your acceptance of the new Terms of Service. If you do not agree to any of these Terms or to any future Terms of Service, do not use or access (or continue to access) the Service. You acknowledge that We own all right, title and interest, including without limitation all Intellectual Property Rights (as defined below), in and to Our Site and/or Services including Our System and related advertisement matching and serving technology and that You will not acquire any right, title, or interest in or to the service except as expressly set forth in this Agreement. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Evereq without restriction. Any attempted transfer or assignment in violation hereof shall be null and void. These Terms, together with any amendments and any additional agreements you may enter into with Evereq in connection with the Service, shall constitute the entire agreement between you and Evereq concerning the Service. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Privacy Policy
At Evereq, we respect and protect the privacy of visitors to sites in our network, and our customers who use our products and services (the “Service”). This Privacy Policy (“Policy”) describe what information we collect, how we use it and what choices you have regarding your information
What information we can collect?
Your name, profile photo, post content, comments, your likes, your email address, your location (if you allow to provide us your location in your browser or mobile device) and any other information you provide us
You also may give us permission to access your information in other services, e.g.: Facebook, Twitter, Github and others online services from which you allow us to obtain your information
We also collect technical information when you use and interact with our products and services:

A "cookie" is a small text file sent to our servers by your computer each time you visit our website, unique to your account in Evereq sites network or your browser. We can use two types of cookies: small software file stored temporarily (session cookie) or placed on your computer’s hard drive (persistent cookie).
The main purpose of a cookie is to allow a web server to identify a user’s computer and web browser, and tailor web pages and/or login information to the user’s preferences. Cookies help us promptly display the information You need and other information which We consider to be of interest to You. By gathering and remembering information about your website preferences through cookies We can provide a better web and marketing experience.
Cookies don’t give us access to users’ computers, and the information we collect through cookies doesn’t include personal information.

Essential cookies: Some of the cookies We use are critical to the functionality of our Site. They are used to keep a user logged into the Site and remember relevant information when the user returns to the Site and uses the Service.
Functional cookies: We also use certain cookies to track users’ activities on the Site, understand their preferences within the Site and improve their user experience.
Marketing cookies: A third set of cookies is provided by third parties and allows us to deliver customized marketing information to our customers based on their Site usage profile and avoid delivering irrelevant marketing to customers.
Clear gifs: Our third-party tracking utility company may employ a software technology called clear gifs that helps us better manage content on our Site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. Unlike cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages. We tie the information gathered by clear gifs to our customers’ personal information, and use them in our HTML-based emails to learn which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and our marketing campaigns. Customers can opt-out of these emails by following the unsubscribe instructions within such marketing emails.

Evereq does not knowingly collect any personal information from children under the age of 13.
How do we use information we collect?
We use the information we collect to provide our products and services to you and make them better, develop new products, and protect Evereq and our users.
Some examples how we use your information includes:
- In customized content on our site
- In emails and Newsletters with relevant updates about your or your friends activity
- In Responses to your questions, comments or feedback
The information we collect may be “personally identifiable” (meaning it can be used to specifically identify you as a unique person) or “non-personally identifiable” (meaning it can’t be used to specifically identify you). We use both types of information, and combinations of both types, as described above. We may use or store information wherever Evereq does business, including countries outside your own.
What choices do you have about your information
- You can access or change your information using our service features.
- Link or unlink your Evereq account from an account on another service
- For some services, you can also choose whether or not to publish your activity on Evereq to that service or back.
- You can close your account at any time. When you close your account, we’ll deactivate it and remove your account profile information from Evereq. Some information that was reposted by other users or some comments you leave on others Posts can retain on site (see our Terms of Use). We may retain archived copies of your information as required by law or for legitimate business purposes.
- Some browsers allow you ability to control cookies or other types of local data storage
- Some mobile devices allows you to how and whether location and other data is shared
How we share your information
We share information you provide in Posts, Comments, your Account Profile page and other places anyone can view.
We also may share information with other services when you've chosen to link to your Evereq account to them (e.g.: Facebook, Twitter or Github)
We may employ third party companies or individuals to process personal information on our behalf based on our instructions and in compliance with this Privacy Policy.
If we believe that disclosure is reasonably necessary to comply with a law, regulation or legal request; to protect the safety, rights, or property of the public, any person, or Evereq; or to detect, prevent, or otherwise address fraud, security or technical issues.
We may engage in a merger, acquisition, bankruptcy, dissolution, reorganization, or similar transaction or proceeding that involves the transfer of the information described in this Policy.
We may also share aggregated or non-personally identifiable information with our partners or others.
How do we make changes to Privacy Policy
We may change this policy from time to time, and if we do we’ll post any changes on this page. If you continue to use Evereq Products and Services after those changes are in effect, you agree to the revised policy. If the changes are significant, we may provide more prominent notice or obtain your consent as required by law. We encourage You to periodically review this page for the latest information on our privacy practices. Your only remedy, if You do not accept the terms of this Policy, is to discontinue use of Sites and Services. "No-Spam" Policy
Evereq has a strict, no tolerance anti-spam policy and will pursue whatever legal steps are necessary to enforce this policy. "Spam," or "Spamming," is also known as Unsolicited Commercial E-mail (UCE) or Unsolicited Bulk E-mail (UBE). Spamming can ultimately hurt all our users who do respect Internet etiquette and who show consideration for others. Our "No-Spam" policy is for the protection of ALL of our clients and their visitors.
Unsolicited Commercial E-mail (UCE) is herein defined as the sending of any email message to anyone not personally known by you unless it is in specific response to a request for information from you. This definition is independent of how and by whom the Email is actually sent.
Unsolicited Bulk E-mail (UBE) is herein defined as the broadcasting of large quantities of unsolicited Email or postings to news groups through any large quantity delivery system. This definition is independent of how and by whom the Email is actually sent.
There is also such thing as search engine spam, comment spam, social networking spam, and all kinds of other spam, which is created, distributed and manufactured with the intent to "pile and dominate" websites with information, links and opinions, which do not relate to the website content or contribute to the immediate dialogues of users.

Customer accounts will be terminated if they send unsolicited email messages. Please report any suspected abuse to abuse@evereq.com. ISPs and blacklists administrators may also contact us at abuse@evereq.com Please forward the complete email in question, including headers. If applicable, please also unsubscribe from the newsletter using the link at the bottom of the email if you no longer wish to receive emails from that sender. We will take the appropriate action against the sender of the email in question. If you believe you have been spammed by one of our clients / users, we sincerely apologize. We ask that you give us an opportunity to firmly and fairly correct and warn the uninformed and to strictly penalize violators by subjecting them to potential fines and immediate cancellation of their accounts, as we aggressively enforce our policy.
Each Evereq user and customer, as well as Evereq services, must agree to only send permission-based emails to Evereq users. "Permission-based" means that all Recipients must have opted-in to receive communications from Evereq or Evereq user / customer.
An opt-in can occur either via a invite form, a sign-up form on a web site, at a point-of-sale sign-up form, or on a physical sign-up sheet. Any opt-in form should include a clear description of what will be sent and how often it will be sent.
You can submit your email address in our invitation form. Other than for the purpose of replying to you with welcome message which contains invitation code, that email address will not be used at all.
